Hourly billing
In England and Wales, family solicitors commonly charge between £200 and £400+ per hour, with senior solicitors and London firms at the top of that range. Every call, email, letter and court document is added to your bill.

Clear, Fixed-Fee Custody Support
Traditional custody cases are often billed by the hour, which makes costs hard to predict. Access 2 Children offers fathers clear, fixed-fee support from a dedicated Family Law Partner, agreed before any work begins.
The real cost of a custody case
For most fathers, the hardest part of a custody dispute is not knowing what it will cost. Traditional family solicitors bill by the hour, and the final figure depends on how the other parent responds and how far the case goes.
In England and Wales, family solicitors commonly charge between £200 and £400+ per hour, with senior solicitors and London firms at the top of that range. Every call, email, letter and court document is added to your bill.
A case resolved early through negotiation may cost a few thousand pounds. A contested case running through a first hearing (FHDRA), a dispute resolution appointment and a final hearing can cost significantly more, particularly where barristers are instructed.
Because hourly billing has no fixed ceiling, many fathers only discover the true cost once they are already committed. With Access 2 Children, your fee is agreed before any work begins.
What affects the cost
The cost of a custody case depends on how it is handled and how far it goes. These are the factors that drive the bill up.
Hourly billing makes the final cost hard to predict. Every letter, call and amendment is charged, so a drawn-out dispute becomes expensive quickly.
Cases that go to several hearings need more preparation: position statements, witness statements and bundles for each stage.
Allegations, fact-finding hearings, CAFCASS Section 7 reports or relocation issues add significant work and time.
Court application fees are separate from support costs. The C100 application fee is paid directly to the court, and Help with Fees may be available.
Most fathers must attend a MIAM before applying to court unless an exemption applies. Mediators charge separately for this.
If the other parent refuses to engage, delays or raises new issues, the work required, and an hourly bill, increases.
Court and process costs
Some costs apply to every father, regardless of how the case is supported.
The main cost is the court fee for a Child Arrangements Order application on form C100, which is currently £263. Fees for related applications, such as enforcing or varying an existing order, are charged separately.
Before applying, you will usually need to attend a Mediation Information and Assessment Meeting (MIAM). Mediators set their own fees, although the Family Mediation Voucher Scheme may contribute for eligible cases. If mediation is not appropriate, the mediator signs your form so the application can proceed.
If you are on a low income or receive certain benefits, Help with Fees can reduce or remove the court fee. Legal Aid for child arrangements cases is limited and generally only available where there is evidence of domestic abuse or child abuse.
Keeping costs under control
The fathers who spend least are usually the ones who are best prepared from the start.
